PJSLAW has confronted the rapid development and increasing complexity of transactions involving information technology and intellectual property with a strong, well founded but innovative corporate law background and a keen awareness of the legal and technical dynamics of these fields. From its early years to the present, our Intellectual Property and Information Technology Practice has involved pioneering efforts in providing services to clients such as Internet service providers, software developers, business process outsourcing (BPO) companies. Our practice includes:

Intellectual Property

  • Conduct of registration eligibility searches and applications for registration of copyright, trademark, patent, industrial design, utility model, and other intellectual property rights, including preparation, review and/or registration of license and franchise agreements and other technology transfer arrangements with the Documentation, Information and Technology Transfer Bureau.
  • Intellectual property due diligence/audit and advising companies on how to deal strategically with IP and innovation, including discussion of various modes of operational efficiency and expansion, from forms of contractual relationships (such as distributorship, consignment, franchise and agency) to appropriate dispute resolution modes.
  • Assisted in the settlement of a synchronization license dispute involving a major local recording label.
  • Assisted in the settlement of a trademark opposition dispute involving local publications.
  • Assisted in the settlement of a trademark dispute involving a significant Filipino retail brand.
  • Assisted in the settlement of copyright infringement dispute involving foreign media company and news aggregator.

Licensing

  • Conducts review of franchise agreements, distributorship contracts, licensing arrangements in various industries, including exemption submissions in the Intellectual Property Office’s DITTB, and recordal of licensing agreements before the Intellectual Property Office.
  • Assisted a significant local food manufacturer in the licensing of its technology and products in Vietnam.
  • Assisted in the review and implementation of various franchise agreements for the establishment of franchise opportunities involving foreign brands in the Philippines.

Data Protection

  • Assisted the Philippine subsidiary of one of the largest pharmaceutical companies in the world based in the US in the review of Philippine legislation and decided cases on data privacy; prepared for the same client a manual on data privacy with respect to data collection, storage and use; conducted training for relevant company personnel with respect to Philippine law on data collection, storage and use.
  • Assisted the Philippine subsidiary of one of the world’s leading manufacturers and distributors of paper products, building materials and related chemicals based in the US in the review of Philippine legislation and decided cases on the right to privacy.
  • Assisted the Philippine master franchisee of a leading global fastfood chain in the audit of their proposed website including review of privacy policy and online data collection, storage and use.
  • Participated for the Philippine subsidiary of one of the world’s leading computer manufacturer and information technology company based in the US in a survey for Asia Pacific jurisdictions on laws and regulations pertaining to data collection and privacy; advised the same client on Philippine laws and regulations on data collection related to the banking sector.
