Open Access by December 2011

The Energy Regulatory Commission (ERC) has passed a resolution on the implementation of open access whereby allowing electricity users to choose their power suppliers by 26 December 2011.

The Decision, posted in ERC website, will initially be available to “electricity end-users with an average monthly peak of one (1) MW for the twelve (12) months preceding December 26, 2011, as certified by ERC to be contestable customers, shall have the right to choose their own electricity suppliers.”

The ERC is mandated by the Electric Power Industry Reform Act of 2001 (EPIRA) to declare retail competition and open access as soon as seventy (70%) percent of the government-owned generating assets and seventy (70%) percent of the independent power producer (IPP) administrator contracts has been privatized. As of the date of the Decision, 79.56% of the generating assets and 76.85% of the IPP contracts have been privatized.
